Litigation is the word used to describe the procedure for a claim in court. In Alberta, more than 98% of claims that are filed in court are settled before a trial in front of a judge. All court claims begin with a written statement setting out your claim and this is filed in court.

After your claim is filed, there are a series of legal steps that move you through the court process to trial. In Alberta, one of the steps you must take before trial is a mandatory mediation to try to settle your claim. Taking this step early on in your court claim may be less expensive and take less time.
